Important: Please read these Terms of Service carefully before using Spiritual Gifts Hub. By creating an account or using our services, you agree to be bound by these terms. If you do not agree, do not use the service.
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “User”) and Spiritual Gifts Hub (“we,” “us,” or “our”), operator of spiritualgiftstesthub.com (the “Service”). By accessing or using the Service — including registering an account, taking an assessment, or purchasing a subscription — you agree to these Terms and our Privacy Policy, which is incorporated herein by reference.
If you are using the Service on behalf of a church or organization, you represent that you have authority to bind that organization to these Terms, and “you” refers to both you individually and that organization.
Spiritual Gifts Hub provides a spiritual gifts assessment platform that allows churches to create and administer spiritual gifts tests, collect results from congregation members, and analyze spiritual gift data across their organization. We also offer a free public spiritual gifts test for individual believers.
The Service is a technology tool only. Results from any spiritual gifts assessment are informational and educational in nature. They do not constitute pastoral counseling, psychological advice, theological guidance, or any professional religious counsel. We make no representation that assessment results are theologically authoritative or spiritually definitive.
You agree not to:
Violation of these provisions may result in immediate account termination, legal action, and/or referral to appropriate law enforcement authorities. We reserve the right to seek injunctive relief and monetary damages for violations.
Our Property: The Service, including its design, code, features, branding, logos, text, graphics, and all underlying technology, is the exclusive intellectual property of Spiritual Gifts Hub and is protected by United States and international copyright, trademark, trade secret, and other intellectual property laws. Nothing in these Terms grants you any ownership interest in the Service.
Your Content: You retain ownership of content you create within the Service, including assessment questions and church-specific materials (“Your Content”). By uploading Your Content, you grant us a limited, non-exclusive, royalty-free license to store, display, and process Your Content solely to provide the Service to you.
Feedback: Any feedback, suggestions, or ideas you provide regarding the Service become our property and may be used without compensation or attribution to you.
No Implied License: Nothing in these Terms grants you a right to use our trademarks, trade names, logos, domain names, or other distinctive brand features without our prior written consent.
As a church administrator, you own the data you and your members input into the Service (“Church Data”), including member information and assessment responses. We act as a data processor on your behalf.
You are solely responsible for: (a) obtaining appropriate consent from your congregation members before collecting their data through the Service; (b) complying with applicable data protection laws with respect to your congregation's data; (c) the accuracy and lawfulness of any data you collect.
We reserve the right to use anonymized and aggregated data (data that cannot identify any individual or church) for product improvement, research, and marketing purposes.
By creating an account, you agree to receive transactional emails related to your account (password resets, billing receipts, service notifications). These cannot be opted out of while you maintain an active account.
If you opt in to marketing communications during registration or at any time thereafter, you agree to receive promotional emails, product updates, and ministry resources from Spiritual Gifts Hub. You may opt out at any time by clicking “Unsubscribe” in any marketing email or by contacting us at [email protected].
If you provide your mobile phone number and opt in to SMS communications, you agree to receive text messages from Spiritual Gifts Hub. Standard message and data rates may apply. Message frequency varies. Reply STOP to opt out at any time. Reply HELP for assistance. See our Privacy Policy for full SMS terms.
The Service integrates with third-party providers including Stripe (payment processing), Amazon Web Services (hosting and storage), and Resend (email delivery). Your use of the Service is also subject to those providers' terms of service and privacy policies. We are not responsible for the acts or omissions of third-party providers.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED SERVICE. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR AVAILABLE AT ALL TIMES.
We do not warrant the accuracy, completeness, or theological validity of any spiritual gifts assessment results. Results are tools for self-reflection and ministry planning — not authoritative spiritual determinations.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SPIRITUAL GIFTS HUB, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION — ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
You agree to indemnify, defend, and hold harmless Spiritual Gifts Hub and its officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; (d) your violation of any applicable law or the rights of any third party; or (e) your collection and handling of congregation member data.
By You: You may cancel your account at any time from your account settings or by contacting us. Cancellation takes effect at the end of your current billing period.
By Us: We may suspend or terminate your account at any time, with or without notice, for: (a) violation of these Terms; (b) conduct we determine to be harmful to other users, us, or third parties; (c) extended periods of inactivity; or (d) if we discontinue the Service.
Effect of Termination: Upon termination, your right to access the Service ceases immediately. Sections 5, 10, 11, 12, 14, and 15 survive termination.
These Terms are governed by the laws of the United States and the State of Texas, without regard to conflict of law principles. Any dispute arising out of or related to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association, conducted in English in Texas.
Class Action Waiver: You waive any right to participate in a class action lawsuit or class-wide arbitration against Spiritual Gifts Hub.
Notwithstanding the above, we may seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property rights.
We may update these Terms at any time. We will notify you of material changes by email or by a prominent notice within the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms.
